Access to the www.planmydebs.ie (the “Site”) and the use of information contained therein is subject to the terms and conditions set out below. These terms and conditions are important and are for the protection of both users of the Site and ourselves. Please take the time to read the terms and conditions carefully. By using or visiting the Site, you expressly agree to be bound by these Terms and all applicable laws and regulations governing this Site.

This Site is owned and operated by Lewis & Godsil Limited trading as Plan My Debs. Lewis & Godsil Limited is registered in the Republic of Ireland (company registration number 463707). Please note that references to “we” and “us” mean Lewis & Godsil Limited trading as Plan My Debs, our subsidiaries and associates.

The contents of this Site, including these terms and conditions, are subject to change and to being updated without notice.

This Site is provided on an ‘as-is’ basis. Although we have made all reasonable efforts to ensure that all of the information on the Site is accurate at the time of inclusion, we do not represent that this is the case and it should not be relied upon as such. We do not make any warranties or representations as to the completeness, accuracy or reliability of the contents of this Site. Accordingly you agree not to hold us responsible for any inaccuracies or omissions.

Plan My Debs Service & Events

Plan My Debs provides debutante ball event management services which provides information and offers tickets for individual events as agreed with representatives of the host school or organiser (the ‘Host Committee’) together with add-on goods and services for sale through this Site.

Tickets are sold subject to any house rules and regulations operated by the venue or organiser and standard terms and conditions printed on the individual event ticket. Right of admission is reserved and may be refused without reason. The organisers reserve the right to refuse admission to the venue for reasons of public safety, overcrowding or any other reason. Admission to events is by full ticket only.

Similarly, Plan My Debs cannot be held responsible for the actual content of the event or any aspect of the performance delivered by the venue. We reserve the right to make essential changes to the event programme without prior notice.

Site Users & Permitted Use

Site users include all visitors and registered users of the Site. Registered users are those users who register their details with the Site in order to avail of Plan My Debs services in accordance with these Terms.

The information provided by registered users will only be used in accordance with our Privacy Policy which is available on our website and is incorporated into the Terms and Conditions.

Plan My Debs is not responsible for any content uploaded by Site users. Users who submit content to this Site, whether reviews, images, stories, software or other copyrightable material must ensure that the content they upload does not infringe the copyrights or other rights of third parties (such as privacy or publicity rights).

The following is a partial list of the kind of content that is illegal or prohibited for users to upload onto the Site. It includes content that:

• is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; could be harmful to minors;
• harasses or advocates harassment of another person;
• involves the transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”;
• promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
• promotes an illegal or unauthorised copy of another person’s copyrighted work;
• contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
• displays pornographic or sexually explicit material of any kind;
• provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
• provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
• solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
• engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Plan My Debs reserves the right to monitor and remove any posts or reviews placed on this Site by any of its users. We also reserve the absolute right to block any customer from using the Site or any other facilities offered by Plan My Debs for indefinite periods at their discretion.

Access to and use of this Site is at the user’s own risk and we do not represent or warrant that the use of this Site or any material downloaded from it will not cause damage to property, including but not limited to loss of data or computer virus infection.

Unless otherwise specified the contents of all the pages contained in this Site are the copyright of Lewis & Godsil Limited. Ownership of all intellectual property rights upon this site is vested in Lewis & Godsil Limited. All rights reserved.

The information content graphics, text and images, buttons, trademarks, trade names and logos and software (the “Materials”) contained in this Site are protected by copyright and other intellectual property laws, Irish and international laws and international treaties. Such Materials may be used only for viewing the Site in the ordinary course or as a resource for purchasing products offered through the Site. The contents of this Site (part or all) may not be copied, transmitted, amended, reproduced, distributed or published in any form whatsoever is strictly forbidden without the prior written permission of the copyright owner.

Ticket purchase

Tickets for each event will go on sale on planmydebs.ie twelve months prior to your relevant event date and will only be available to registered users. Plan My Debs provides no guarantee with respect to the availability of tickets for any given event and provides no assurance that tickets will be available for purchase by the user.

The user/customer is wholly responsible for ensuring that their ticket order has been completed and has been successful and that all aspects of their ticket order are correct. Before confirming the purchase, please review all the ticket information displayed which is based on the choices you made and ensure these are fully correct. Plan My Debs will not be held responsible for erroneous orders or inadvertent multiple orders and cannot refund, cancel, exchange or amend tickets ordered as a result. If you are unclear as to whether your order for tickets has been successfully placed and to avoid inadvertently placing multiple orders, please contact info@planmydebs.ie for assistance.

It will be possible for customers to download and print their tickets online at the time of purchase or, in the case of instalment payments, upon payment for their ticket in full. It is the responsibility of the customer to ensure the information provided is correct and they have the facilities available to download and print their ticket. Please contact info@planmydebs.ie immediately if you experience difficulties in this regard so efforts may be made to make alternative arrangements. It is the customer’s responsibility to note and safely keep the confirmation number associated with their order for future reference.

Plan My Debs reserves the right to limit the number of tickets and type of tickets which can be ordered by a customer either in a single or multiple orders. Plan My Debs reserves the right to refuse any order or cancel an existing order without notice or providing a reason.

Plan My Debs is not responsible for any loss, inconvenience or expenses incurred by the user/customer in the event of malfunction or failure of the system which may result in failure to secure any or the desired number of tickets. We reserve the right to cancel without notice any order placed by a customer trying to exceed the specified ticket limit, by whatever means.

Plan My Debs is dependent on other external suppliers of services (i.e., web hosting, hardware supply and support, remote back-up and disk mirroring) in providing this Site and services to users and customers and customers recognise that we can only rely on those suppliers pursuant to their individual terms and conditions and service level agreements. In the event that we experience difficulties with one or more of our suppliers we will make every effort towards rectifying any such problems. Plan My Debs will not however be responsible for any loss of any nature caused to the customer as a result of difficulties with any of the Plan My Debs suppliers.

Payment

Payment will be requested at the time of booking. You may be offered the option to pay a deposit or pay by instalment in the case of certain events. Please note that such arrangements will be subject to terms agreed in advance with the individual host school or organiser and will be set out in accordance with our cancellation terms. You may be asked to supply certain information including credit / debit card or other payment information and personal details when purchasing goods or services on the Site. By providing such information you represent and warrant that it is accurate, complete and current. Orders may be delayed or cancelled if we are not given complete and accurate information and / or are unable to contact the person who has placed the order and / or the cardholder.

You agree to pay all charges (including merchant, shipping and handling charges) incurred by users of your payment mechanism at the prices in effect when the purchase is made. You will always be fully informed of such charges in advance of purchase and will always have the option not to proceed with availing of the service in question, if you wish. We will not be held responsible for any inconvenience, loss or expense incurred by the customer should they choose not to avail of the service. You are responsible for paying any taxes applicable to such purchases. Booking fees and postage fees are non-refundable.

When you order you grant us permission to contact your bank to validate the credit / debit card details you entered and to seek permission to debit this card for the total amount due. Similarly, you grant us the right to submit your personal and bank details to anti-fraud systems for assessment during the purchase process.

Ticket Terms and Conditions

In purchasing tickets for a Plan My Debs Debutante Ball you agree to the following event rules:

1. Each attendee must have valid Government ID which proves that they are 18 years of age or over to gain access to the venue
2. Right of admission is reserved by the management to refuse entry to anyone that appears to be intoxicated by any drug
3. No food or beverage may be brought into the Venue or Nightclub or on their grounds.
4. The management reserves the right to refuse admission and may on occasions, have to conduct security searches to ensure the safety of the patrons.
5. In the interest of Health and Safety, the management reserves the right to stop the function at any time during the night if there is any trouble caused by guests. If this situation arises, security will insist on removing all guests from the venue premises and grounds.
6. Any damage or loss caused to the Venue or Nightclub as a result of inappropriate behavior by any person(s) will be held liable and charged to the person(s) responsible.
7. Venue Management, 3rd Party Supplier and Plan My Debs accept no responsibility for any personal property.
8. Booking a room or rooms within the Debs venue is not permitted on the night of the Debs.
9. We regret that tickets cannot be exchanged or refunded after purchase.
10. Tickets are sold subject to the management’s right to alter or vary the programme due to events or circumstances beyond its control without being obliged to refund monies or exchange tickets.

Event Cancellation / Rescheduling

In certain circumstances, events may be cancelled or rescheduled by Plan My Debs due to reasons amounting to force majeure (such as Act of God, war, epidemic, pandemic or natural disaster outside of the Company’s control which could not have been reasonably foreseen) or due to the host or venue’s failure to comply with the terms of the agreement under which Plan My Debs is engaged, for example a failure to meet minimum numbers provided on booking.

In circumstances where the school or host Committee wishes to cancel the event or you wish to cancel your individual booking, there will be no refund available.

In the circumstances where PlanMyDebs is forced to cancel the event. There will be a non refundable amount of €30 per ticket, but the remaining balance of your purchase will be refunded.

To gain a refund on tickets for a cancelled event, please contact info@planmydebs.ie within 10 days of cancellation of the event. Booking and postage fees are non-refundable.

It may be the case that events are rescheduled by us, the host committee, or the venue beyond our control. In that event Plan My Debs agrees to use their best endeavours to make suitable alternative event arrangements and agree the same with the host committee. Should this happen, we will try to contact you as early as possible by email, at the e-mail address you have supplied at the time of booking and inform you of all or any alterations and amendments to your booking.

Plan My Debs will not be held responsible for any inconvenience, losses of any kind or expenses incurred by the customer as a result of an event being cancelled, rescheduled or moved to a different venue.

Order Cancellation, Refund and Amendment

Tickets cannot be refunded, exchanged or transferred in any way unless the event has been cancelled. In all other cases, once an order has been placed it cannot be cancelled, amended or the number of tickets changed in any way.

Lost, Stolen or Destroyed tickets

The ticket holder is responsible for care of the ticket after purchase. Plan My Debs or their agents are not responsible for damage to or loss of the ticket and will not be in a position to replace the same. In the case of e-mail tickets, if a lost or stolen ticket is re-printed it will contain the same reference code as any previous printed copies of the same ticket. Only one entry to the event per reference code will be permitted on a first come first served basis.

Add on Services & Legal Disclaimer for Third-Party Web Sites

Plan My Debs will offer the customer the opportunity to avail of add-on services for their event through their registered account. Customers may purchase a voucher for such third party services at the time of ticket purchase or subsequently in advance of their particular event and in accordance with the terms and conditions of the third party supplier. Unless otherwise stated such vouchers are redeemable with the third party service provider up to and including the date of their scheduled event at which time they expire. Each voucher is subject to the terms and conditions of the relevant third party service provider which are available upon request. It is the customer’s responsibility to acquaint themselves with the said third party terms and conditions.

Plan My Debs may provide as a convenience to you, links to web sites operated by other entities and persons, but makes no representation whatsoever about any such Sites which you may access through this one and any links to such sites does not mean that Plan My Debs (or any other person involved with the provision and maintenance of this web site) endorses or accepts any responsibility for the content, or the use of such Sites. If you use these Sites, you do so at your own risk.

Distance selling

Due to the instantaneous nature of the transactions made on this Site the provisions of the EC (Protection of Consumers in Respect of Contracts made by means of Distance Communications) Regulations 2001 will not apply.

Limitation of Liability

Your use and browsing of the Site is at your own risk. If you are dissatisfied with any of the materials contained in the Site, or with any of these terms, your sole and exclusive remedy is to discontinue accessing and using the Site.

In no event do we accept liability of any description including liability for negligence for any damages whatsoever resulting from loss of use, data or profits arising out of or in connection with the access, use, inability to use, the results of use or performance of this Site or any its contents. We shall not under any circumstances be liable to any customer by reason of any representation or warranty, condition or other term or any duty of common law, or under the express terms of these conditions of sale, for any consequential, special, incidental or punitive loss or damage (whether for loss of current or future profits, loss of enterprise value or otherwise) and whether occasioned by the negligence of Plan My Debs, its employees or agents or otherwise, even if advised of the possibility of such damages.

Governing Law and Jurisdiction

Information appearing on this Site is provided in accordance with and subject to the laws of Ireland and the laws of Ireland govern the conduct and operation of this Site. The courts of Ireland have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these Terms and Conditions, the information contained in this Site and its use.

Force Majeure

Lewis & Godsil Limited our subsidiaries and associates shall be under no liability for any failure, delay or omission on its part if the same arises from any cause beyond Lewis & Godsil Limited’s reasonable control including (but not limited to) acts of God, acts or regulations of government or other authorities, war, fire, strikes or other industrial disputes, power failure, failure of telecommunication lines connections or equipment or failure or defects in any hardware or software owned or supplied by third parties or server or merchant banking faults.

Miscellaneous

These terms and conditions constitute the complete contract between you (the individual using this Service) and Lewis & Godsil Limited and cannot be amended either orally or in writing.
